Terms of use

 
Except as otherwise expressly agreed, InboundAsia Co. Ltd. and its client (or “Client”) and/or Agent (or “Agent”) agree that the terms and conditions for the services rendered by Inbound Asia to the Client, whether on an individual or a tour basis (or the “Services”) shall be governed by the Booking Conditions set out below and that the said Booking Conditions shall form an entire part of the service contract, whether verbal or written, entered into between Inbound Asia and the Client/Agent.

VALIDITY All prices quoted to the Client/Agent are on a net basis and in United States Dollars and valid according to the date specified on the Inbound Asia printed tariffs and/or quotation and/or invoice issued to the Client/Agent. Inbound Asia warrants that the prices or rates quoted to the Client/Agent are correct at the time of issuance of the Client’s/Agent’s quotation and/or invoice but are subject to change in line with market, tax or currency fluctuation, with or without prior notice.

RESERVATION AND CONFIRMATION   Reservations are to be made to our office or to our appointed General Sales Agent. Upon confirmation of a reservation, a 30% (thirty percent) deposit is requested, and the total package tour price for the Services should be paid at least 30 days (thirty days) prior to client\'s arrival in the destination country or starting date of the tour, or otherwise Inbound Asia may at their sole discretion cancel the bookings without any refund of sums already paid to Inbound Asia by the Client/Agent. Inbound Asia also reserves the right to change any arrangement (including tours, programs, prices and services) in the best interest of its Client/Agent, with or without prior notice.

PAYMENT   Except as otherwise agreed by Inbound Asia, Client’s payment shall be executed by cash, credit card or traveler cheques. Except for cash payment, a service charge may apply. In cases where credit facilities have been agreed with the Client/Agent, payment shall be executed by swift or telegraphic transfer to the appropriate Inbound Asia bank account. Any bank charges levied by the sending bank relating to transfers to Inbound Asia must be paid by the Client /Agent. CANCELLATION  Save for the case where a Client/Agent loses its deposit as mentioned above, charges for cancellation of bookings are not levied by Inbound Asia but if hotels, carriers and other contractors apply charges for cancellation, the Client/Agent shall be liable to pay those charges to Inbound Asia or to the concerned parties directly as the case may be.

VOUCHERS Vouchers for booking arrangements and a copy of the Client’s itinerary will be issued to the Client on arrival by an Inbound Asia representative.

LIABILITY Inbound Asia shall always do its utmost to provide the Services to the best of its capacity and upon the satisfaction of the Client. It is the understanding of both Parties that Inbound Asia acts as an intermediary between the Client/Agent and airlines, hotels, transport operators, local tourist offices and other contractors providing the Services to the Client.  Inbound Asia shall in no event be liable to the Client/Agent, by reason of breach of Services or unsatisfactory Services provided to the Client by third parties or by way of indemnity or in tort or otherwise, for any loss, injury, damage, delay, change in schedule or other adverse events which are beyond the control of Inbound Asia and/or sustained by an act or default of any person or company providing the Services to the Client. The Client/Agent warrants that Inbound Asia shall not be responsible and/or liable for additional expenses and/or damages incurred due to any delay, accidents, natural disaster, political action or unrest.

CLAIMS   All disputes, claims and litigation regarding the Services shall first be settled by way of negotiation and mutual understanding.  In the event such negotiation and mutual understanding would fail, the disputes, claim or litigation shall be finally settled by local arbitration and according to Civil Laws of the Socialistic Republic of Vietnam; All claims must be submitted in writing within 30 days after the end of the Services.

Included in quoted Escorted Programs: Tour prices are include all accommodations as noted in the itinerary; meals as specified; arrival and departure transfers (regardless of arrival and departure days); fully guided sightseeing as noted in the itinerary (including park and entrance fees); bottled water supplied during sightseeing; selected beverages with group meals; *services of an Inbound Asia Tour Director (please see condition noted below); baggage handling of two pieces per person for international flights, other conditions/restrictions may apply for internal routes, please see under Baggage section; hotel taxes; **gratuities throughout except to your Tour Director and ship’s crew (please see separate section on Gratuities for more details). On group programs. On extension programs: All extensions are locally guided.

**Gratuities on Escorted Programs are included for hotel/restaurant staff, porterage and local guides/drivers. Gratuities are not included for the Inbound Asia Tour Director or, where applicable, which are at the travellers discretion and should be based on the level of satisfaction with the service received. Recommended guidelines for each area visited are provided in Inbound Asia’s pre-tour documentation.

**Gratuities on Independent Programs (Signature and Tailor Made). Gratuities are not included in the program price and are at the discretion of the traveller. Recommended guidelines for each area visited are provided in Inbound Asia’s pre-tour documentation.
Not included in quoted escorted program prices: Passenger Travel Protection Program; international and internal airfares unless otherwise noted; cost of obtaining passports or entry visas; airport departure taxes unless otherwise noted; excess baggage charges; gratuities to the Inbound Asia Tour Director or ship’s crew as outlined in the Gratuities on Escorted Programs section; meals other than specified in the itinerary; beverages other than noted under included in pre-tour documentation, sightseeing not included in the itinerary; personal expenses such as laundry, communication charges and optional activities (which are subject to availability).
Inbound Asia Tailor Made Travel Programs Terms and Conditions for the Inbound Asia Tailor-Made Travel programs and Tailor-Made Portfolio hotels may vary from those shown above. Details as of individual Itinerary  or Booking Agreement.

Itineraries. Accommodations  and arranged sightseeing are subject to change at any time due to unforeseen circumstances or circumstances beyond Inbound Asia’s control. Every effort will be made to operate tours as planned, but alterations may occur after the final itinerary has been issued.

Quoted tour prices include planning, handling and operational charges, and are based on current rates of exchange, tariffs and taxes as of date and issue of service contract. Inbound Asia reserves the right to increase tour prices to cover increased costs, tariffs and taxes, and to reflect fluctuations in foreign exchange markets. Modification of tour content to accommodate a smaller group size will not affect published tour price.

INBOUND ASIA LTD. also reserves the right to withdraw a tour or any part of it to make such alterations in the itinerary or with the tour inclusions as it deems necessary or desirable and to pass on to tour members any expenditures or losses caused by delays or events beyond its control.

Immediate Check in. On programs where immediate check-in has not been included in the tour price Inbound Asia requests that the hotels do their utmost to facilitate this service, however, this is not guaranteed. Most hotels allow check-in to take place during the mid-afternoon. Should you wish to have your room ready for immediate check-in upon arrival, Inbound Asia can arrange this for an additional charge. Please ask for details and prices.

Active Elements. On specified itineraries some active elements are incorporated into the tour. To enjoy the tour as intended a minimum level of fitness is required to participate. The level required would be equivalent to what is obtained by routine daily exercise such as golf, jogging, energetic walking, tennis, etc. Activities during the tour could include (but are not limited to) hiking, off road walking, white water rafting, and navigating uneven terrain. In case of any open queries or  Questions regarding a Tour program , the client is requested to clarify this issues on the date of Reservation with Inbound Asia.

Baggage. Tour prices include the handling of two pieces of baggage per person. Weight restrictions on some routes on internal air flights may apply; details will be provided with preliminary tour documentation. Baggage and personal effects are at owner’s risk throughout the travel program. Check with the airline for other baggage restrictions applicable to international flights.

Inbound Asia’s Passenger Travel Protection Program, which provides cancellation coverage, medical coverage and protection against lost or damaged luggage, is not included in the tour price and it is strongly recommended. Further Details available on Request

Child Policy. On non-family programs, unless otherwise indicated on the individual tour page, a minimum age of 10 years is required. On family programs there is no minimum age requirement unless indicated on the individual tour page. However, some activities contained within a tour may have a different age restriction than the overall minimum age requirement. Details will be provided at the time of booking.

Please Note: Inbound Asia reserves the right to marginally exceed the published maximum group size on family programs to accommodate a family.

Passports and Visas. Valid passports are required for travel to the destinations in this brochure. Check with your travel agent or Inbound Asia for the latest visa requirements.

Registration and Payment Schedule. For all booking, a deposit of 30% signs up at the time of booking. Final payment is due 30 days prior to departure. If your reservation is made within 90 days of departure, the entire cost of the trip must be paid at the time of confirmation.

Cancellation.
Cancellations received by INBOUND ASIA 60 days or more prior to departure will be subject to a $50 per person/per tour cancellation fee; 59-30 days, will be subject to 10% of the program price; 30 - 20 days will be 20% 20 to 7 days will be 75 % of program price and 7 days or less will be subject to 100% of program price.

Claims and Refunds. Refunds are not made for any missed services, except for verifiable extenuating circumstances. Please see our Limits on Responsibility on this page. For verifiable claims to be considered, they must be received in writing within 30 days of the termination of the program and be accompanied by supporting documentation and/or a statement from the Operating Company verifying the claim. Any adjustment considered will be based on the actual price of the services involved and not on a per diem basis. Adjustments will not be made for unused sightseeing trips or meals. Inbound Asia will not accept any liability for any claims that are not received within 30 days of the termination of your travel program. All claims for days missed while travelling should be made in writing within 30 days of the termination of the program.

Photography on Travel Programs. Inbound Asia reserves the right to take photographs during the operation of any program or part thereof and to use them for promotional purposes. By booking a reservation with Inbound Asia, program members agree to allow their images to be used in such photographs. Program members who prefer that their images not be used are asked to identify themselves to their travel program escort at the beginning of their program.

Limits on Inbound Asia’s Responsibility: Inbound Asia, its employees, shareholders, officers, directors, successors, agents and assigns, does not own or operate any entity which is to or does provide goods or services for your trip. It purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers (including from time to time other affiliated Inbound Asia’s companies). All such persons and entities are independent contractors. As a result Inbound Asia is not liable for any negligent or willful act of any such person or entity or of any third person.

In addition and without limitation, Inbound Asia is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.

There are certain inherent risks in adventure travel of the type involved here. These include, but are not limited to, risks of white hiking, walking safaris, downhill, (for example, equipment failures, ice or other trail obstructions) and in all trips dangers of animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. Passenger assumes all such risks with regard to these possibilities.

Travellers Representations: The Traveller represents that neither he nor she nor anyone traveling with him or her has any physical or other condition or disability that could create a hazard to himself or herself or other members of the tour. Inbound Asia  reserves the right to decline to accept anyone on a trip. IA reserves the right to remove from the trip, at his or her sole expense, anyone whose condition is such that he or she could create a hazard to himself or others, or otherwise impact the enjoyment of other passengers on the trip.
PAYMENT OF THE PROGRAM PRICE CONSTITUTES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS SET OUT HEREIN AND IN MORE SPECIFIC PRE-DEPARTURE PASSENGER DOCUMENTATION, INCLUDING THE RESERVATION CONFIRMATION FORM.
